1. Acceptance of Terms

By accessing or using the Moments AI website, subscribing to the Moments AI App, or interacting with Shelly AI, you agree to be bound by these Terms & Conditions. If you do not agree, please discontinue use of the website and app.

These Terms apply globally and are compliant with Australian Consumer Law (ACL), GDPR (EU/UK), and international privacy standards.

2. Nature of the Service

Moments AI is a wellbeing-focused, informational digital product delivering general educational guidance through AI technology (“Shelly AI”).
The service does not provide medical, psychological, psychiatric, legal, or emergency advice.

All content is for general informational purposes only.

3. Eligibility

Users must be at least 18 years old to purchase or use the App.
By subscribing, you represent that you meet this age requirement.

4. Subscription, Billing & Renewals

4.1 Subscription Options

  • Monthly Subscription: Renews automatically every month.

  • Annual Subscription: Renews automatically every 12 months.

4.2 Automatic Billing

Upon purchase, you authorise Moments AI to charge your payment method on a recurring basis until cancellation.

4.3 Pricing Changes

We may adjust prices with reasonable notice. Updated pricing applies to subsequent billing cycles.

5. Cancellations & Refund Policy

5.1 Monthly Subscriptions

You may cancel at any time before your next billing date. Access continues until the end of the paid period.

5.2 Annual Subscriptions

You may cancel prior to the renewal date.
Your subscription remains active until the end of the current term.

5.3 Refunds

Due to the instantly accessible, digital nature of the product:
All sales are final. No full or partial refunds will be provided.
This complies with Australian Consumer Law for digital goods.

6. User Accounts & Security

You must keep login credentials confidential.
Accounts may not be shared, sold, or transferred.
You are responsible for all activity under your account.

7. Intellectual Property

All content within Moments AI, including text, scripts, audio, branding, UI design, and AI training materials, is the exclusive property of Moments AI.Family.

Users are granted a non-transferable, non-exclusive, revocable licence to access the App for personal use only.

Copying, redistributing, or training external AI models with Moments AI content is prohibited.

8. Use Restrictions

You agree not to:

  • Use the App for illegal or harmful purposes

  • Attempt to reverse engineer, copy, or duplicate Shelly AI

  • Share, publish, or misuse responses outside personal use

  • Harass or misuse the AI system

Violation may result in immediate account termination.

9. Service Availability

While we strive for consistent availability, the App may experience interruptions due to updates, maintenance, or technical issues.

We are not liable for downtime but will take reasonable steps to restore service quickly.

10. Limitation of Liability

To the fullest extent permitted by Australian law:
Moments AI, its directors, employees, and agents are not liable for:

  • Decisions made based on AI guidance

  • Losses resulting from technical interruptions

  • Any direct or indirect damages related to use of the App

Your use of the App is at your own discretion and risk.

11. Not a Medical or Emergency Service

Moments AI cannot diagnose, treat, or respond to medical emergencies.

If you or your child are in crisis or experiencing a medical issue, contact emergency services or a qualified healthcare provider immediately.

12. Global Compliance (Australia + International Users)

Moments AI complies with:

  • Australian Consumer Law (ACL)

  • Privacy Act 1988 (Cth)

  • GDPR (EU/UK)

  • CCPA (California, where applicable)

Users outside Australia acknowledge they may be subject to local taxes or regulations.

13. Termination

We may suspend or terminate accounts that violate these Terms.
Users may request account deletion at any time.

These Terms are governed by the laws of New South Wales, Australia, and applicable international consumer protections.
